Legal Club of America® is a nationwide discount legal referral service with a network of over 20,000 attorneys who have contracted to provide you with numerous free and discounted legal services.
Members will be given a toll-free number for legal assistance. You will be referred to a Plan Attorney based on three criteria: area of law, language spoken and location. Membership includes you, your spouse and any dependents 23 and younger. You may use as many plan attorneys, practicing any area of law, anywhere in the country as often as you need. Contingency Fee Discounts
Attorneys often work on a contingency fee basis on cases such as personal injury and collections. This fee is usually expressed as a percentage of the amount collected or awarded. In some cases, fee maximums are set by state law. In these matters, members' fees will be a 10% reduction of the state maximum rate or the attorney’s usual rate, whichever is lower.
Guaranteed Fixed Hourly Rates
In the event a member requires extended legal representation, plan member attorneys are currently contracted with us to charge no more than $75.00 per hour for in or out-of-court representation. In most cases, the attorneys will be able to estimate the amount of hours any given case may consume prior to beginning work on the case.

Level III Benefits— $120.00
With the Educators Professional Liability Plan, you will be protected against a broad range of exposures associated with your educational duties, including the following allegations:
· Injuries to students under your supervision
· Improper placement of students
· Improper methods employed in instruction, counseling, research design, etc.
· Hiring unqualified persons
· Failure to educate
· Failure to promote students or grant credit
· Violation of student civil rights
· Negative consequences in the implementation of the recommendations of research studies
· If you supervise other employees and are sued by one of them regarding covered personnel matters, the policy will pay 90 percent of your defense costs for a maximum of $5,000, subject to a $100 deductible.
· The plan will pay up to $250 for your initial consultation with an attorney, and it will pay up to $750 of the cost of having an attorney represent you at a formal hearing of a school board or other authority if you are threatened with a job action, such as a termination, suspension, reassignment or demotion. You also will receive up to $4,000 for legal fees, subject to a $100 deductible, if you decide to sue because of the job action and the judgment in the suit is in your favor. Of that $4,000, $750 is available to you regardless of the suit's outcome.
This plan does not respond to criminal actions (except as noted below), corporal punishment where prohibited by law, or to acts or omissions with respect to work carried on as a part-time private consultant. This plan will not cover psychological services rendered by you as a part-time private consultant or if you have a full– or part-time private psychological practice.
Three Additional Features!
After a $100 deductible, the plan pays 90 percent of your attorney’s fees if you are accused of the following:
A suit demanding non-monetary relief (Up to $35,000 for defense costs
Sexual abuse
provided you are found not guilty or the charges are dismissed ($50,000 per
Insured, per claim, subject to a $100,000 aggregate limit).
Criminal charges rising out of corporal punishment provided you are found not guilty or the charges are dismissed ($10,000 annual maximum)
The insurance provided by this plan is in excess of any other valid and collectible insurance or indemnity you might have with regard to the claim, including coverage provided by your school district and/or school board.

Who’s Eligible?
Regular coverage — any Level III member of the Higher Education Partnership who is a W-2 employee of an educational entity; i.e., school, university, or college. This must be your main occupation. Owners and board members are not eligible for coverage.
Only registered nurses, licensed/certified school psychologists and physical therapists, performing medically related teaching or services in the normal course of their duties as an employee of a school, are eligible for coverage.
What’s My Coverage Amount?
Your coverage provides $2,000,000 for all claims and a policy aggregate limit of $3,000,000 for all claims against members of the Association. Defense costs are paid in addition to this amount!
Your plan will provide coverage for claims brought AT ANY TIME, as long as the occurrence that resulted in litigation occurred while your Educators Professional Liability policy was in effect. You’ll be covered even if you’ve dropped the coverage – as long as your coverage was in force when the incident happened.

A surplus lines tax is included in your premium. This plan is available only to members residing in the United States and the District of Columbia.
This plan becomes effective on the date you become a Level III member of HEP.

Commonly Asked Questions about HEP’s $2 Million
Liability Insurance Policy
The following are a few questions asked of the insurance administrator concerning the professional liability policy.
Q. If a student is injured while under my supervision, will I be protected from a lawsuit?
A. Yes. For both your lawyer’s costs and any damages awarded against you.
Q. Am I covered for lawsuits based on sexual harassment or abuse?
A. Yes! The policy provides up to $50,000 to reimburse your attorney’s fees provided you are found to be not guilty or the charges are dropped.
Q. If a student or employee sues me for violating their Civil Rights, am I covered?
A. Yes, and this is an important feature of HEP’s protection. The NEA policy has a $250,000 limitation for lawsuits alleging Civil Rights violations. The HEP policy has no such limitation.
Q. Will this policy pay damages or judgments if I lose a lawsuit?
A. Yes, as long as the lawsuit arises out of your educational activities and the cause is not excluded.
Q. What kind of things are not covered by this policy?
A. Criminal acts for which you are found guilty.
Activities not arising out of your educational activities.
Intentionally inflicting bodily injury, except corporal punishment.
Q. What happens if my job is “on the line?”
A. An important feature of the HEP policy is the job protection benefit section. If you are threatened with termination, suspension, reassignment, or demotion - our plan provides for consultation with an attorney, and it will pay for the cost of having an attorney represent you at a formal hearing of a school board or other authority.
Q. The NEA says that your policy is “limited” in coverage. Is that true?
A. All insurance policies are “limited” to the amount of liability, including the NEA’s. However, membership in the HEP provides you with an individual policy which means the limit of liability is $2,000,000 per occurrence. You will receive a personal certificate with your name as the insured.
